Data Protection and Privacy
General Data Protection Regulation (GDPR) Compliance: We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR). Our Privacy Policy, which is incorporated by reference into these Terms, details how we collect, use, and protect your personal data. Please review our Privacy Policy.
Legal Basis for Processing: We process your personal data based on contractual necessity (to provide the Service), consent (for marketing), legitimate interests (to improve the Service), and legal obligations.
Your Rights: You have the right to be informed and to access, rectify, erase, restrict, port, and object to the processing of your personal data. You also have the right to withdraw consent and lodge a complaint with the supervisory authority. Contact our Data Protection Officer at [email protected] in case you have questions, wish to change your consent or wish to file a complaint.
Purchasing and Confirmation
To purchase any of the services, you must register for an account, provide the required information and pay the amount stated (including any applicable taxes and fees).
You represent and warrant that: (i) you have the legal right to use the chosen payment method; and (ii) all information supplied is true, complete, and correct.
By submitting payment information, you grant us the right to provide that information to third-party payment processors for the sole purpose of facilitating the completion of your purchase.
We reserve the right to refuse or cancel your order at any time for reasons including, but not limited to: Service availability, errors in the description or price of the Service, or suspected fraud/unauthorised transactions. We are not liable for any loss or damage resulting from a failed or cancelled purchase.
Payment
Prices are as listed on the Website at the time of order and are exclusive of VAT or other applicable taxes unless stated otherwise.
Fees are debited at the time of purchase. Access is granted upon receipt of the total fee or timely payment of agreed instalments under a payment plan. RECOA may immediately suspend or terminate access without notice in the event of a failed payment, reversal, or chargeback.
You are responsible for all third-party costs, including bank fees, foreign transaction fees, exchange rate differences, and any hardware or internet service provider charges required to access the Service and in connection with payments.
Content Accuracy, Errors, and Updates
We strive to ensure all Service information is accurate; however, we reserve the right to correct errors or technical inaccuracies regarding pricing and availability. To ensure that the Services are kept up to date and quality assured, RECOA reserves the right to update or modify course curriculum and materials at any time. While we aim for continuous availability of the Services, we do not warrant that Services will be available without interruption. If a significant error is discovered after a purchase, we will notify you and provide a resolution, which may include a refund or a credit (in full or in part) of payments made.
Service Availability
The Service is provided on an 'as is' and 'as available' basis. While we strive to ensure a seamless experience, RECOA does not guarantee that the Service will be entirely uninterrupted, timely, or error-free.
Access may be suspended or restricted for necessary maintenance or updates. We will endeavour to provide advance notice of any scheduled downtime. RECOA is not liable for factors beyond our reasonable control, including internet outages or failures by third-party infrastructure providers.
To the maximum extent permitted by law, RECOA disclaims liability for losses arising from:
- Temporary unavailability or technical platform outages;
- Delays in accessing course materials due to third-party technical failures; or
- Individual user hardware or connectivity issues.
Cancellation and Refunds
Due to the digital nature of the Service, all purchases are generally non-refundable once access to the course materials has been granted. RECOA may, at its discretion, consider refund requests on a case-by-case basis.
Course Access & Duration
Access to each course or programme is granted for a limited period as specified at the time of purchase on the website ('Access Period'). The Access Period begins on the date the user is enrolled in the course, whether by individual purchase or assignment by an organisation.
Unless otherwise stated in writing, access will automatically expire at the end of the Access Period. Upon expiry:
- the user will no longer be able to access course content, materials, or assessments;
- any incomplete course material may no longer be accessible after expiry;
- no refunds will be issued for unused portions of the course in question.
RECOA may, at its sole discretion, grant extensions to the Access Period upon request. Users may request an extension by contacting [email protected].
Accounts – Personal Use and Licence Restrictions
When you create an account with us, you must provide us with information that is accurate, complete, and current always. Failure to do so constitutes a breach of the Terms of Use, which may result in immediate termination of your account on our Service.
Each account registered on the RECOA platform is strictly personal and is intended solely for the individual named at the time of registration. Your account, login credentials, and access to any purchased course or programme constitute a single-user, non-transferable licence. You may not share, lend, transfer, or otherwise grant access to your account or its contents to any other person, whether free of charge or for payment.
Prohibited: Account and Licence Sharing
The following actions are strictly prohibited and constitute a material breach of these Terms of Use:
- Sharing your login credentials (email address and/or password) with any other person;
- Allowing a third party to use your account, whether simultaneously or at separate times;
- Reselling, sublicensing, or redistributing access to any course, module, or downloadable material;
- Purchasing a single licence on behalf of multiple individuals (whether within the same organisation or otherwise) unless a separate corporate or group enrolment agreement has been entered into with RECOA in writing.
Consequences of Unauthorised Sharing
RECOA actively monitors account activity for signs of unauthorised access or concurrent use. If we detect or reasonably suspect that an account is being shared or used by more than one individual, we reserve the right to: (i) immediately suspend or permanently terminate the account without prior notice; (ii) revoke access to all purchased courses with no obligation to provide a refund; and (iii) pursue any additional remedies available under applicable law, including recovery of damages for lost licence revenue.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
Corporate Licensing and Licence Reassignment
Where courses are purchased by an organisation for use by its employees, each licence grants access to one named user at a time.
The purchasing organisation is responsible for assigning licences to individual users and ensuring compliance with these Terms of Use.
Licence reassignment (i.e. transferring a licence from one user to another) is permitted only if agreed with RECOA.
RECOA reserves the right to refuse or restrict licence reassignment requests where misuse is suspected or where reassignment is requested repeatedly in a manner inconsistent with the intended single-user licence model.
Acceptable Use and Academic Integrity
Users agree to use the Service solely for lawful educational purposes and in a manner consistent with fair use and academic integrity. The following actions are strictly prohibited:
- cheating, plagiarism, or submitting work that is not the user's own;
- sharing, distributing, or publishing assessment answers, solutions, or course materials;
- collaborating with others in assessments where such collaboration is not expressly permitted;
- attempting to manipulate course progress, completion status, or assessment results;
- misrepresenting identity, including impersonating another user or allowing another person to complete coursework on your behalf;
- using the Service or its content for unauthorised commercial purposes.
Any breach of this section may result in: suspension or termination of access to the Service; invalidation of course results or completion certificates; and denial of future access to RECOA services.
Limitation of Liability
RECOA, its directors, employees, partners, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential or punitive damages. This includes, without limitation, economic loss, loss or damage to electronic media or data, goodwill, or other intangible losses, resulting from (i) your access to or use of the Service; (ii) your inability to access or use the Service; (iii) any conduct or content of any third party on or related to the Service; (iv) any content obtained from or through the Service; or (v) the unauthorised access to, use of or alteration of your transmissions or content.
Intellectual Property
The Service and all contents, including but not limited to text, images, graphics, video, or audio, are the property of RECOA and are protected by copyright, trademarks, database, and other intellectual property rights. You may display and view portions of the material from the different areas of the Service only for your own non-commercial use.
You are not authorised to (i) copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit or distribute any of the materials of the Service without prior written permission; (ii) record by any digital or analogue means, or relay via screen-sharing or live broadcast the Service given; (iii) use the materials of the Service in the provision of any other course or training; (iv) modify, adapt, merge, translate, disassemble, decompile, or reverse engineer any software forming part of the Service.
General
RECOA reserves the right to recover any reasonable debt collection and legal costs incurred in connection with a breach of the Terms of Use.
RECOA may update or amend the Terms of Use from time to time to comply with law, meet changing business requirements or correct errors without providing notice to you.
No failure or delay by RECOA in exercising any right or remedy under the Terms of Use shall operate as a waiver of that right or remedy. If any provision of these Terms is found to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
